Fair tax treatment for ITC contractors

Lorely Burt, LibDem MP for Solihull and alumna of Swansea University, has tabled an Early Day Motion seeking redress for long-standing unequal treatment by the Revenue of professional contractors. I was lucky enough to escape the iniquitous IR35 when I was contracting regularly, but many colleagues were unnecessarily penalised and continue to be so. It is to be hoped that many MPs will sign the EDM to show the strength of feeling against IR35.

Thanks Frank, the Early Day Motion describes beautifully the way that IR35 has failed to deliver what HMT wanted and continues to do so. Case Law is relatively clear on how to trade in your own business outside the scope of IR35, but it takes practice, effort and agreement of the contractor, staffing company and agency. Contracting is a major part of our economy and after 10 years living with IR35 do not think that HMT can buck market forces that demand the temporary project based skills of knowledge based workers.
